Acknowledgments & Waiver

LORAIN OHIO KARTPLEX — PHOTOGRAPHER / MEDIA RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION

In exchange for being granted access to the Lorain Ohio KartPlex facility ("LOK") to photograph, film, or operate camera or unmanned aircraft equipment, I acknowledge and agree:

1. Assumption of Risk

Motorsports facilities are inherently dangerous. Karts, vehicles, and equipment travel at speed and can leave the racing surface without warning. I voluntarily assume all risks of property damage, bodily injury, or death arising from my presence at the facility, whether trackside, in the paddock, or anywhere on the grounds.

2. Release of Liability

I release and discharge LOK, its owners, operators, employees, and agents from any and all claims arising out of my access to the facility, including claims based on their ordinary negligence.

3. Insurance

I represent that I carry general liability insurance of at least $1,000,000, that LOK is named as an additional insured, and that a valid certificate is on file. If I operate an unmanned aircraft (drone), I represent that I hold a current FAA Part 107 Remote Pilot Certificate and separate drone/UAS liability insurance.

4. Indemnification

I agree to defend, indemnify, and hold LOK harmless from any claim, injury, or damage caused by me, my equipment, or my unmanned aircraft to any person or property, including third parties, spectators, and participants.

5. Dress Code & Safety

I agree to comply with LOK's dress code and safety requirements at all times while on the grounds:

  • Long pants (no shorts)
  • Closed-toe shoes (no sandals or open-toe footwear)
  • Covered shoulders (no tank tops or sleeveless shirts)
  • Avoid clothing that is mostly red, yellow, orange, or black (flag colors); white or blue preferred
  • Wear the high-visibility vest provided at all times unless cleared by management
  • Attend the mandatory safety briefing before entering any trackside or restricted area

6. Trackside Conduct & Rules Compliance

I agree to follow all posted rules, staff instructions, designated-area restrictions, and the Trackside Conduct & Safety Rules, and I understand my access may be revoked at any time. I acknowledge I must keep a physical barrier between myself and the track, remain within 25 yards of a manned corner stand, communicate my movements with Corner Marshals and Race Control, never cross a hot track, never cross a cold track without a Corner Marshal's permission and supervision, and refrain from any controlled substances prior to the end of daily track activities.

7. Image Rights

I will not use imagery captured at the facility for commercial or retail purposes without LOK's written permission. I grant LOK a non-exclusive, royalty-free license to use my images for LOK's marketing and promotional purposes; I retain ownership of my work.

8. Application Cutoff & Vetting

I understand that applications must be submitted at least 10 days before each event, that access is limited and subject to review, and that submitting this form is a request that may be approved or denied.

9. Governing Law

This agreement is governed by the laws of the State of Ohio.

You will also be asked to sign a printed copy of this waiver when you arrive.
